Using wills and probate records for genealogy can lead to unexpected “inheritances” of your own: clues about relatives’ identities, wealth, personal belongings, and family relationships. Here’s how wills can help your family history—and Margaret’s tips for finding and using them.
Using Wills and Probate Records in Genealogy Research
“Where there’s a will, there’s a way” to find out more about your family’s history.
Wills are legal records created to direct the settlement of a person’s property and other final affairs after his or her death. Probate (or estate) records are created after an individual’s death as part of the legal distribution of the estate and payment of debts. You’ll often find wills as one of many kinds of the documents included in probate records.
Wills and other probate records are valuable research tools, but are frequently neglected as sources of genealogical information. People often focus strictly on birth, marriage, and death records when searching out their family histories. If you rely solely on those records, your research will encounter many brick walls in the early 1800’s.
Probate records and land records were often the only official documents left behind to tell the stories of ancestors who lived prior to the legal requirement for the registry of births and deaths.
Wills of slaveholders can also be valuable tools in conducting African-American genealogical research. Before the Civil War, enslaved people were listed in wills because they were valuable property of slaveholders.
For instance, in the 1863 Smyth County property tax records, it is noted that Abijah Thomas owned 56 slaves, which were valued at $53,800. Some were given their freedom within wills, while others were transferred to other members of the family or sold. For instance, one of the first wills recorded in Smyth County is that of Hugh Cole.
Within his will, he says the following: “I bequeath to my beloved wife Martha Cole a negro girl named Amanda which she is to hold during her natural life.” The mention of an enslaved person in a will—along with any personal description of him or her—may be the only surviving document to mention that person by name.
Within another Smyth County will, recorded on February 20, 1835, a woman named Elizabeth Blessing left the following directive: “I will and desire that my negro woman Betty be free at my decease, and must see to her own support during her life, as I shall not make any provision for her out of any part of my estate.”
Information Found in Wills Varies
You can find just about anything in a will!
One organ, one compass, chain and plotting instruments, two chests, one hat rack, one music rack, one old United States map. These are some of the items found in the appraisement bill of the personal property belonging to the estate of Abijah Thomas, who lived in the well-known Octagon House in Marion, Virginia.

Also included in his personal property is a church bell. The story behind the bell is intriguing and illustrates the significance of the probate process.
Abijah Thomas utilized the bell at his foundry works in Marion, Virginia, to indicate shift changes. For decades, the oral history surrounding the bell indicated that he had donated it to the Wytheville Presbyterian Church before he died. The court documents reveal a different story.

Since Abijah died intestate, the court appointed three men to appraise his personal property. During this process, the bell was valued at $75. It was sold on September 1, 1877, to the Presbyterian Church in the town of Wytheville, Virginia, as shown in the above list of items sold from his estate.
This document dispels the family myth surrounding the church bell. This is just one of many examples of the types of stories you find in probate records in courthouses all across the United States.
Genealogical Information May be Found in a Will or Probate Records
Wills and probate records can pass along unexpected genealogical wealth to you. You may find the following information in them: date of death (or approximate date of death), name of spouse, children, parents, siblings and their place of residence, adoption or guardianship of minor children, ancestor’s previous residence, occupation, land ownership, and household items.
Probate records also contain such interesting stories that they can even be read for entertainment!
Whenever I go on a research trip, I usually drag some poor, unsuspecting soul along with me. That person is usually my Mom. While she enjoys the scenery on our drive to different courthouses, she rarely enjoys the time spent at the courthouse.
Some of the research I do requires me to stay at the courthouse for several hours. That has posed a problem in the past since I haven’t known how to keep Mom occupied. But I have found the perfect solution. When we arrive at the courthouse, I find an old will book and let her start reading.
My mom enjoys reading the stories in these old—and sometimes tattered—books. One of her favorite stories came from a will in Henry County, Virginia. It is the will of Addie T. Thornton and reads as follows:
“I also give to my nephew Thomas T. Earles, fifty ($50) in cash to be deposited in some safe Banking Institution, on interest until he arrives at the age of twenty-one (21) years old and then the principal to be invested in a watch and I request that a monogram with both his and my name, one on inside and the other on outside of watch.”
Obviously, Addie Thornton cared deeply for her nephew, Thomas, and wanted to make sure he remembered her for the rest of his life.

Stories like these are so much more meaningful than just a date of birth, marriage or death. Wills can help us know who these people were, how they lived and what was important to them during their sojourn here on earth. We can learn of their struggles and their successes. We can tell what their lives were like by reading through the lists of household items included in the inventories that are recorded.
And with stories like Addie’s bequest of the watch, we can also learn about ancestors’ personalities and how they expressed (or occasionally withheld) love for others through the final disposition of their belongings.
How a Will is Created
Before beginning probate record research, it is important to be familiar with the probate process and legal terminology associated with these records. It is estimated that, prior to 1900, about half of the population either left a will or was mentioned in one. Those who died having left a will are said to have died “testate.” Those who died without leaving a valid will died “intestate.”
A typical, legally-recognized will contains certain critical elements. It should be in written form and it must have signatures of the person leaving the will (“testator”) and witnesses, who attest to the validity of the document. A codicil is a document created by the testator to amend the will.
Once the testator dies, the will is presented to the judicial authority by a family member or executor/executrix (person appointed by the testator to see that his/her wishes are carried out), accompanied by a written application or petition for probate.
These petitions include names and addresses of the closest living relatives. The court then admits the will to probate and sets a hearing, providing an opportunity for interested parties to contest the will. The will is then recorded and the executor is given the authority to settle the estate. During this process, an inventory of the estate is made.
Some wills contain detailed information, regarding the testator’s final wishes. At times, these requests will shed light on relationships that might not otherwise be discovered. This was the case for a will on file at my local courthouse. Due to the nature of the requests made by the testator, I have changed the last name of the family to Smith. This wife was, obviously, upset with her husband and the circumstances of their marriage, providing clear details of her grievances for future generations.
“Since my husband has never made me a part of his family and has completely cut me out of ever living in Chihowie, Virginia [the husband’s hometown], or never provided me with a home or paid any of my bills and has broken all marriage contracts that we agreed to—I hereby decree that I be buried in Round Hill Cemetery at Marion, Virginia, where I own a lot—that my body or anything I own or possess will never be taken into Chilhowie or the Smith household.
My husband has never taken me into his own home, and furthermore stated, backed up by his nephew and his wife, whom he turned everything over to shortly after our marriage—that I would never own or live on a foot of the Smith ground, even though I have tried to build or buy or remodel a home in Chilhowie, Virginia, at my own expense.
“I give all books and material things pertaining to books to the Smyth County Library, Marion, Virginia, as I am sure that my family would not want anything to fall into the hands of anyone who has mistreated me.
“My husband has kept our marriage strictly on a time clock basis since his nephew and his wife moved back to Smyth County, and under their influence he comes at 6:30 or 7:00 p.m. (whichever is convenient to them) or later, and leaves promptly in the morning by 8:00 or 8:30 a.m., never calling during the day or show[ing] any sign of caring. He changed completely after they returned to Chilhowie to break up the marriage. Therefore, if I am still his wife, or otherwise, see that my wishes are carried out and that my remains and possessions remain in Marion.”
Where to Find Wills and Probate Records
The best place to search for a will is at the courthouse where your ancestor lived, if you can reasonably go there yourself.
Since the probate process is a function of state governments, the laws governing the maintenance of these records and their location will vary by state and should be researched before making a trip to the courthouse.
For example, in Virginia, probate records are maintained within the Circuit Courts and independent cities. In Massachusetts, probate records are found in county Probate Courts.
A useful resource for figuring out how U.S. probate records are organized state-by-state is free on the Ancestry.com wiki: Red Book: American State, County and Town Sources. Scroll down to click on the name of the state in question. Then go to the right side and click on the probate records link for that state to read about these records.
Once you have determined where the wills for your state/county are housed, the next step in the research process is to locate the Index for Wills. Even–perhaps especially–if you are unsure of the date of death for one of your ancestors, you may want to look through the index of wills (an example is shown here). Even when no specific death record exists, you may be surprised to find probate records that reveal the date of death, a list of heirs and more.
There will, most likely, be several index books, organized by year spans. These books serve as a compass, pointing you to any available probate records that may include your ancestors. The index is divided by devisor (the person making the will) and devisee (any person who is named in the will, as the recipient of property).
The research process will be incomplete if you do not conduct a search for your ancestors among the list of devisees. Even if you fail to find their names among the devisors, they could have inherited property from someone else.
Probate records include more than just the will of an individual. You may find letters of administration, lists of heirs, inventories, bills of appraisement, guardianships and other documents related to the settlement of an estate. In some counties, all these documents are found in the same collection. Other counties maintain these records in separate collections. It is important to understand the manner in which probate records are organized for your particular county.
The probate research process should not be rushed. Valuable records may be overlooked when time dictates the quality of your research. For this reason, it is important that you set aside ample time to comb through the probate records. If you find yourself confused about abbreviations or the location of records within the courthouse, there is usually someone in the records vault who would be happy to assist you. Never be afraid (or embarrassed) to ask for help.
Fortunately for many of us who can’t easily get to every ancestor’s courthouse, there are some wills available online on genealogy websites, including two of the genealogy giants, FamilySearch and Ancestry.com.
The free FamilySearch.org hosts millions of probate records from the U.S. and around the world (click here to browse their probate and court record collections). Many of these collections are marked “browse-only,” which means they are not yet searchable by name online. You just have to page through them. Additionally, libraries or genealogical societies in your ancestor’s hometown or county may have books with abstracts from local wills or other resources related to local probate record research.

Finding the will of one of your ancestors is an amazing experience. Walking into the vault of a courthouse sometimes feels like walking into a time machine. As you read through the pages that tell of people who lived so long ago, you feel like for even just a small moment that you have gone back in time. A great way to discover all that the Internet Archive has to offer is to think in terms of categories of records. I’m going to share with you ten genealogy record categories that include several specific types of records.
Start your search for each category using just a few keywords such as:
a location (town, county, etc.)
the type of record,
a family surname, etc.
Next try applying some of the filters found in the column on the left side of the screen. I try several combinations of searches to ensure that I’ve found all that the Internet Archive has to offer. Let’s get started:

From the United States Patent and Trademark Office. Keep in mind that your ancestor may be mentioned in a patent even though they did not file it.

Although there doesn’t currently appear to be a large number of probate records, the Internet Archive does have some. Try searching by location to see if it includes a probate record for others from the same community. For example, a prominent shopkeeper might list many in the town who owed them money.

I searched for the small town where my husband’s ancestors lived for several generations and found a great video from 1954. It featured a parade float sponsored by his great grandfather’s business and several faces I recognized! Watch Winthrop Days.
Genealogy Records Category #10: Collections!
A collection is a group of records submitted by a user. Often times these will be organizations, libraries and archives.
Visit the Books to Borrow collection. You will need to be logged into your free Internet Archive account in order to borrow books. You can borrow the book in 1 hour increments. In some cases, you can choose a 14-day loan. If there is only one copy of the book available, the 1 hour load will be the only option. If there are no copies available you can join a waitlist. No waitlist is necessary for one hour loan ebooks.

Also, when you find an Item of interest, click the Contributor link to see all of the items uploaded by the user. It’s very likely they will have additional similar items.
Tip: Use the Internet Archive Advanced Search and Search Help
One advantage to using the Advanced Search is when you are searching for items from a specific timeframe. It’s much more efficient than clicking the box for very year in the range in the filter.

Question from Sue: What does metadata mean? Lisa’s Answer: Metadata is data that describes other data. For example, the date of upload is metadata for a digital file that you find online. Metadata is often added by the person or institution doing the uploading to the Internet Archive. I like to search both “Metadata” and “text contents”.
Question from CA: Date filter really applies to date posted not date of item u r looking for….correct? Lisa’s Answer: In the case of genealogical documents, the date typically refers to the date of original publication rather than the date posted. You will find dates back into the 19th century in the filters.
Question from Mary: is there a print icon? I don’t see it. Lisa’s Answer: Instead of printing, look for the download options. Once downloaded to your computer, then you can print.

Question from Susie: Would this site have membership of Rotary clubs and such type groups? Lisa’s Answer: Absolutely! Search for “rotary club” and perhaps the name of the town or locality.

Question from Sally: Is broadest search METADATA? Does it catch everything? Lisa’s Answer: No. Metadata is the default. I would strongly advise running both Metadata and text context searches for your search terms.
Question from Amy: Lisa, do you know of a way to correct records that are incorrectly or in sufficiently tagged? Lisa’s Answer: To the best of my knowledge, you can only do that if you were the one who uploaded the item. If anyone else reading this has found a way to edit or tag other user’s items, please leave a comment below.
Question from John: You may have mentioned this but what is the difference between searching metadata or searching text? Lisa’s Answer: Searching metadata is only searching the data (like tags) that were added to provide more information about the item. A text context search will search all the text that was typed including the title and description. I recommend searching both ways. Keep in mind that not all user’s include detailed descriptions, which is why metadata is very important.
Question from K M: Why does Allen County Library have this archive? Lisa’s Answer: I think it may be because the Internet Archive provides affordable cloud storage which can be a big expense when offering online records.
Question from Karen: Lisa will you explain the download options? Lisa’s Answer: Options are based on the type of item. For print publications you will often find you can download the item as an EPUB, PDF, Full Text, etc. Download options can be found by scrolling down just below the item near the description and Views. You can also found download options for Adobe files while viewing the item in the viewer. Click the three dots in a circle icon just below the search icon.
Question from Barbara: Would audio include old local radio programs? Lisa’s Answer: Absolutely!
Question from Margaret: What about information on the Mayflower? Lisa’s Answer: Yes. Search Mayflower and then use the filters to narrow your results by Topic & Subject and by Year.
Question from Jeremy: Any pointers on Swiss Mennonites, Lisa? Lisa’s Answer: A search of Swiss Mennonites brings up 21 items, some of which look rather interesting. Otherwise, like with all genealogy research, formulating a more specific question can help you craft a better search query at the Internet Archive.

Updates to two of the Freedmen’s Bureau record collections will wrap up this week’s records you can dig into.
IRELAND – RECORDS, GUIDES, AND BOOKS
The New England Historical and Genealogical Society is offering access to their Irish resources for FREE for a limited time. So hurry before it ends on August 9th and see what luck you have digging up your Irish ancestors.
You will need to sign-up, but remember, it’s free. Once you have logged on, you will begin your search here.
Many Irish researchers have difficulty finding records because of the destruction of the Public Record Office in 1922. Not only can you browse the records available, but also the subject guides and books for Irish genealogy.
UNITED STATES – PENNSYLVANIA – NATURALIZATION RECORDS
The Chester County, Pennsylvania website has made their naturalization indexes available for the year span of 1798-1935. To search their indexes is free, but there is no name search field. You may have to scan several pages to find the record that may interest you. The database is also available to search from Ancestry.com and allows you to search by name, date of event, and place of origin.
The index of naturalizations include the name of the individual, name of native country, and a date. The original record could hold additional information. You can request a copy of the original record from their webpage. To learn more about that, click here.
UNITED STATES – NEVADA – MARRIAGE & DIVORCE
The most difficult records too find are often those that were created within the last 50 years. Due to the scarcity of recent records, we are pleased to see Ancestry has added a new database titled Nevada, Marriage Certificates, 2002-2015. You can search by name, date, location, and spouses name.
The digital image of the marriage records differs from year to year and location to location, but generally, you will find the couples’ names, ages, date and location of the marriage, and the person who officiated the wedding.
Nevada, Divorce Records, 1968-2015 has recently been updated on Ancestry as well. This index includes nearly half a million divorce records. You can use the index to locate the county the divorce took place, and then contact that county for the original records. You won’t find the reason for divorce in this index, but you can find the county of divorce and the divorce file number that will help locate the further records you want.
UNITED STATES – NEBRASKA – PASSENGER LISTS
A passenger list database for Omaha, Nebraska? Yep, but these are passenger and crew lists of air manifests between the years of 1958-1965. The collection is titled Omaha, Nebraska, Passenger and Crew Manifests of Airplanes, 1958-1965. If your Omaha relative did a lot of air travel, these records may be of interest to you. These records were were recorded on a variety of forms turned over to the Immigration and Naturalization Service. Some details included the name of the airline, type of aircraft, flight number, places of departure and arrival, dates of departure and arrival, full name, age, gender, physical description, military rank (if any), occupation, birthplace, citizen of what country, and residence. For military transports, you may even find the next of kin, relationships, and addresses. Later, manifests may include visa or passport numbers.
UNITED STATES – MINNESOTA – PASSENGER LISTS
The same is true in this database, Minnesota, Passenger and Crew Lists, 1957-1962 at Ancestry. This collection includes both air travel and ships coming into Minnesota ports. The original records were originally digitized by the National Archives and Records Administration. Information you may collect from these digital images include:

Ethnicity, nationality or last country of permanent residence
Destination
Arrival date
Port of arrival
Port of departure
Ship name
UNITED STATES – GEORGIA – BONDS AND LICENSES
Ancestry has added the Savannah, Georgia, Licenses and Bonds, 1837-1909 database this week. You will find digital images of records from the City of Savannah’s Clerk of Council relating to people and businesses. These records usually include the name of person’s name, occupation, name of business, record date, record place, and subject.
With about 1/3 of Americans claiming British ancestry, chances are that at some point you will need to extend your research across the Atlantic Ocean. Genealogical research in the British Isles has some important differences when compared to the United States. Guest blogger Kate Eakman, a Senior Researcher for Legacy Tree Genealogists, clarifies confusing terms and helps you get your research started on solid footing!
Britain? England? The United Kingdom?
When beginning British genealogy research, it’s important to first talk about the difference between British and English research. There are several terms which get used interchangeably but which really refer to different locations.
Great Britain is an island, the largest island in the British Isles.
On the island of Great Britain are three of the four sovereign nations which make up the United Kingdom, or the U.K.: England, Wales, and Scotland. Northern Ireland on the island of Ireland is the fourth country of the U.K.

Usually, when people talk about their British ancestors, what they really mean are their English ancestors. Although we Americans often treat the two words as interchangeable they really aren’t, and I suspect our English friends giggle a bit when they hear us misuse the words.
The four countries of the U.K. have some similarities but many important differences, and that is equally true for genealogical research. Rather than trying to explain all of those differences, this post will focus on English research.
One last thing to keep in mind when we talk about genealogical research in England is that today the country is divided into counties, which are sort of the equivalent of states in the U.S. Older records might refer to those counties as shires, and over time the borders have shifted, shires and counties were added, divided, or absorbed into each other. So a good map or two will be a useful tool to keep handy while you research your English ancestors.

What do you know?
Before beginning British genealogy research and making that leap across the pond, it is a good idea to consider what you already know about your English ancestors. Of course, you have a name, and you probably have an approximate date of birth.
Were you fortunate enough to find the name of a town or county where that ancestor lived or do all of the census reports and vital records simply say “England”?
If the ancestor arrived as an adult, what occupation did he pursue?
When did he or she arrive in the U.S.? Are there any clues on the passenger list to tell you where to start looking?
Once you have reviewed all of the information you have already acquired about your English ancestor, it’s time to start your research.
Beginning British Genealogy Research with the Census
The first step in most genealogical research is to study the existing census reports. Designed as a means to count the population for a variety of years, the census of Great Britain (including Scotland) is taken every ten years with the earliest records available in 1841. Due to very restrictive privacy laws, the most recent census available is from 1911, with one really valuable exception being the 1939 Register, available at FindMyPast.
Used for genealogical purposes, the census can give a snapshot of the family at the time the census was taken, as well as provide invaluable information such as the birthplace of the individual being recorded, occupation, birth year, and familial relationships. Elderly parents, or widowed mothers, aunts, or sisters, can be discovered living with younger members of the family.
Drawbacks of using the census for genealogical purposes include inaccurate name spellings, inaccurate age reporting, and inaccurate assumptions made by the enumerator. Another thing to keep in mind is that in the 1841 census the enumerated rounded down to the nearest five years the ages of people over 15. So a person who was listed as 25 could have been 25 through 29 years old.
It is important to remember that for the census reports through 1901 the enumerator copied the household information into books, and these copies are what we have today. Of course, when information is copied it is susceptible to error. The person who completed the census form may have had difficult-to-read handwriting, or the enumerator may have entered things on the wrong line. The individual reports have been kept for the 1911 census and offer a greater likelihood that the information they contain is very accurate.

Detailed transcripts of English census records are available for free on FamilySearch and the images can be found for a fee at FindMyPast.
It is important to remember that for the census reports through 1901 the enumerator copied the household information into books, and these copies are what we have today.
Civil Registry of Vital Events
All English births, marriages, and deaths were required to be registered in a civil registration office beginning in July of 1837. In addition to the records themselves, there are indices which list the name of the person who was born, married, or died, the place where the event was registered, and the quarter and year in which the event occurred. Because the General Register Office (GRO) will only search one year on either side of the date provided, it is best, but not required, to include the index information when ordering documents from the GRO.
Free BMD is a free database which allows you the most freedom to search for the birth, marriage, and death index record of your relatives. You can enter whatever information you know including the place where the event happened, a specific year or range of years, age, and mother’s maiden name.
Depending on the time period, the index may be handwritten or mechanically printed. The information can then be used to order a copy of the actual record from the General Register Office (GRO) in England for about $10 per record.

The information contained in birth records includes:
Name, date, and place of birth;
Father’s name (if given at time of registration), occupation; and
Mother’s name, maiden surname.
The parents’ places of birth were added after 1969, and the mother’s occupation is listed after 1984.
Marriage records include:
Date and place of marriage;
Name, age and marital status (spinster/bachelor, widowed, divorced) of the bride and groom;
Occupation and usual address;
Name and occupation of the fathers of the bride and groom, with a note if either man was deceased at the time of the marriage;
Names of the witnesses;
Name of the person who solemnized the marriage.
Death records in the United States are often relied upon to provide the names of the parents. English death records do not include that information and therefore are not as useful for genealogical purposes. Each death record includes:
Name, date, and place of death;
Date and place of birth (before 1969 a certificate only showed age of deceased);
Occupation and usual address;
Cause of death;
The identity of the informant.
There are other records available, which we will talk about in a later post, which can be used to find and trace your English family members. The largest group are the religious records, and sometimes those can help you extend your family back in time to the 1600s – 400 years or more!
Beginning British Genealogy Important Take-Aways…
“Great Britain” is an island. “The United Kingdom” is a country. And “England” is a country. Normally, when people are talking about their British ancestors they are referring to their English ancestors.
England has counties, or what used to be known as “shires,” which function sort of like our states. The borders have changed over time, as have some of the names, so use a map when necessary to verify where you are researching.
Census records are available from 1841 through 1911. Really good transcriptions are available for free at Family Search, or on the for-fee site Find My Past. And remember that age idiosyncrasy about the 1841 census.
Finally, civil birth, marriage, and death records are available from the GRO. You can use the index listings to find the most likely match for your ancestor, and those can be found online at Free BMD.

The 4th Annual Northwest Genealogy Conference

What to preserve first? The most precious and original items you have!
Restoration tips:
Clean documents and photos with archival sponges. Lay the item perfectly flat. Gently place a finger or hand to hold it steady. Work with the sponge from the center outward, in small sections.
Keep two-dimensional items as flat as possible.
Encase fragile items in Mylar sleeves (buy from archival supply companies).

Visiting an archive:
Call ahead! Don’t trust the operational hours from the website. Ask about parking ? it’s often very limited. Ask ahead about access to archival items of interest.
Archive etiquette: Follow the rules. Be courteous when working with staff.
Museums, societies, archives, and libraries may all have collections in back rooms you can’t see?but you can ask for them.
Vertical Files – in folders in cabinets
Manuscript Collections – underused in genealogy! Ask for finding aid.
Loose Records – the working papers of a court case, for example
Unprocessed Records – not yet incorporated into the official collection
Tips for using your mobile devices in archives:
Ask for procedures for taking photos with your own device. There may be rules against this or a use fee.
Capture the source information by photographs: cover page, page number, folder, box number, manuscript collection name, etc.
