Celebrating Freedom and Records Access: 50 Years of FOIA and Genealogy

Happy July 4th–and Happy 50th to the Freedom of Information Act! Read more about the FOIA and genealogy records we can access because of it.

Today we in the United States celebrate our Independence Day with grateful hearts and parades. Well, genealogists with U.S. ancestors have an extra reason for fireworks: today marks 50 years since Congresss signed the Freedom of Information Act into law, and the U.S. became one of the first nations to open its records to the public.

The Freedom of Information Act

The FOIA opens certain kinds of information about the federal government and certain information created by the federal government. It doesn’t apply to everything, including documents that relate to national security, privacy and trade secrets. The FOIA also only applies to documents created by the federal government, not state or local governments.

Since it was passed, the FOIA has continued to be expanded and amended. Over the years, the numbers of FOIA document requests has skyrocketed, too. In the first five years after the FOIA passed, it only resulted in about 500 total requests for information–that’s an average of just 100 per year. Last year alone, there were more than 700,000 requests!

The FOIA and Genealogy

So, of course we have to ask the question: how well do FOIA and genealogy go together? As it turns out, quite well. My favorite FOIA request is for an ancestor’s Social Security application (the SS-5 form). This is the form that generated the assignment of a relative’s Social Security number and was the first step to receiving any Social Security benefits. It’s what the very limited information on the Social Security Death Index comes from, as well as the much-richer (but not comprehensively available) Social Security Applications and Claims database at Ancestry.com. That was released last year and caused a LOT of us to do a serious genealogy happy dance.

But if you want to see everything in that SS-5 application, you should order an image copy of the original (you can now also order a computerized abstract of it, which is cheaper but might not get everything right). Here’s what an SS-5 application looks like:

This one confirms the names of an African-American man’s parents–parents who survived slavery and left few other records of their existence. This man was part of the first generation in his family to legally learn to read and write. His signature is on the record.

You can also access other key 20th-century genealogy records that haven’t made it online yet–and in some cases, haven’t even been sent to the National Archives yet.

Welcome to this step-by-step series for beginning genealogists—and more experienced ones who want to brush up or learn something new. I first ran this series in 2008-09. So many people have asked about it, I’m bringing it back in weekly segments.

Episode 24: Using Marriage Records in Family History

So far in this podcast series you’ve made a lot of progress. You’ve set up your genealogy database, talked to your relatives, gotten familiar with the Family History Centers and you have your research worksheet to lead you in your investigation backwards in time, through death records and the census.

In today’s episode we’re going to continue working backwards down the records aisle looking for marriage records. Marriage records are a type of vital records, meaning they provide vital statistics for a person’s life. They can be a rich—even vital!—source of genealogical information.

Marriage records, like death and birth records (which we’ll be covering in an upcoming episode) are primary sources. This means that the record was completed at the event or very close to it by someone who was present at the event. That means it’s a pretty reliable source.

There are two types of marriage records: civil records which are recorded with the local government, usually at the county level, and church records, if the marriage took place in a church.

Update: Many government and church marriage records have found their way into major genealogical databases (www.Ancestry.com, www.FamilySearch.org, www.FindMyPast.org, www.MyHeritage.com, etc). Look for indexed records and—if you’re lucky—digitized versions of the actual record. (If you find only indexed records, use the process below to find copies of the actual record.)

Civil/Government Marriage Records

You need to determine where the marriage took place in order to figure out the proper civil authorities to contact. Usually that’s the clerk in the town, county, district or parish where the happy couple said “I do.” In the U.S., chances are it was at the county level, but if you’re not sure, do a Google search on the name of the county and the phrase “vital records” or “marriage records.” Chances are one of the first search results will be a link to the website for that county and hopefully the specific page that will tell you how to request vital records. There you should find specific instructions about how to make the request and any fees involved.

3 Tips for Obtaining Marriage Records for Genealogy

  • Tip #1: Be sure and follow the instructions to the letter because otherwise you will likely have your request returned to you unfilled and asking for more information which just wastes time.
  • Tip #2: As with Death Records, it isn’t necessary to order a certified copy because you are not using it for legal reasons, just information reasons. Certified copies cost more and usually have more requirements to applying for them.
  • Tips #3 Request a complete photo copy (which is sometimes referred to as a LONG FORM) rather than a SHORT FORM which can be a brief transcription of the record. There may be clues in the original record that may be left out (or mistranscribed) in the SHORT FORM.

If all this sounds cumbersome there is an easier to request marriage records and that is through Vitalcheck.com (see below). While it costs more you can order the records quickly and easily online.

If you’re looking for civil records in England or Wales, those records have been officially recorded by local District Registrars who reported to the General Registrar Office since July 1, 1837. These records are probably easiest to access, particularly if you are not in the UK, through FindMyPast.com, which does charge a fee for each record.

Types of Civil Marriage Records:

  • Marriage application. I can’t guarantee they’re available in every county, but it’s definitely worth asking!
  • Marriage license. This record often holds the most genealogical value. It will include their names, ages, residences as well as perhaps their race, occupation, age, and perhaps their parents’ names.
  • Marriage register record. This confirms the marriage actually took place. This may be just a signature and date from the official who performed the marriage, and may be a small section at the end of the marriage license information. (The latter type of record may also be called a “marriage return” or minister’s return.”
  • Marriage certificate. While this record is part of the process it isn’t available through the vital records office. It would have been kept by the couple and will involve some looking around and asking relatives to see if it still exists.

Tip: A marriage license alone does not prove a marriage. A couple could easily apply for a license but never go through with the big day.

Church Marriage Records

Start looking for these records at the Family History Library (www.familysearch.org).

Other places to look:

  • The church if it still exists. Search for their website. Contact the church office and ask if they have records for the time period you’re looking for. If they no longer have the records ask where they are being archived.
  • Check in with the closest local library and ask to talk to the reference desk.
  • Search the WorldCat catalog (see Links).
  • Check the US Gen Web site for the state and county where the marriage occurred (see Links). These sites are run by volunteers and each county has a different variety of records and resources available. Contact the local genealogy or and historical societies and ask for their help.

Other records to look for:

  • Banns of marriage records. Look for a record of the banns in the church minutes or church bulletins.
  • Newspaper marriage announcements. Tip: Keep in mind when you’re searching a newspaper database and you find a listing for what appears to be the right family in the right area but the date is way off, be sure and check it out because it just may be a republishing of the news you were looking for! FamilySearch. To search for marriage records by place, click on Search, then Catalog, then search by location. You’ll find both government and church marriage records listed here. Look at the county level for U.S. government records; look at the municipal level or under the Church records category for church marriage records.

Ohio Memory and Freedmen’s Bureau – 2 Record Groups for Genealogy

One of the great things about genealogy is that there are always new records. Well, not really new records, new OLD records. These records have been around sometimes hundreds of years, but they may have been languishing in the basement of an archive, library or even a private collection. Every day, old records are becoming available, and often  right from the comfort of our own home. Who doesn’t love that?! When we can get our hands on those records, it can throw the doors open to new possibilities. Our genealogy brick walls start shaking in their boots because it can take just one record, the right record, to knock it down.

In this article and video we will explore two major genealogy record collections. They are very unique, and yet have some important things in common. Both the Ohio Memory collection and the Freedmen’s Bureau collection are online, and they are both free. Click below to watch the video. If your family has any connection with the state of Ohio – and sometimes I think it’s hard to find anyone who doesn’t have at least one ancestor who did – then you’re going to love the Ohio Memory collection and website.

Even if you don’t have a direct connection with the state of Ohio, like all collections its worth taking a peek. Records don’t care about state lines, and many items in the Ohio Memory collection touch far beyond the Ohio border.

OhioMemory.org was featured in Family Tree Magazine’s 75 Best State Genealogy Websites list in a recent issue of the magazine. I host the Family Tree Magazine podcast, and recently had the opportunity to interview Ohio Memory’s Digital Services Manager, Jenni Salamon for that audio show. Since there’s so much to see at Ohio Memory I’m excited to share the video of that conversation.

What is Ohio Memory?

Ohio Memory is the collaborative digital library program of the Ohio History Connection and the State Library of Ohio. Established in 2000. It was originally established as a bicentennial project they wanted a way to capture some of Ohio’s history and share it more broadly. Ohio turned 200 years old in 2003.

Ohio Memory worked with institutions around the state to build the online collection. They picked their favorite collections which were then digitized and made available as an online scrapbook. Initial submission by 260 institutions resulted in over 13,000 contributed items, and Ohio Memory continues to grow.

Most of the contributing organizations are public libraries, and some are university libraries. Other organizations such as historical societies, government institutions, special libraries, religious archives also contribute to the collection.

What kind of genealogical resources are available at Ohio Memory?

A wide-variety of materials make up Ohio Memory including:

  • Early Ohio state history
  • American Indians
  • The Civil War
  • World War I
  • Maps
  • Drawings
  • Paintings
  • Archaeological artifacts
  • Photographs
  • Journals
  • Objects
  • Oral Histories (audio and video)
  • Newspapers
  • Yearbooks
  • Present Day government records

All 88 Ohio counties are represented in the Ohio Memory collection.

Tips for Searching for Records at Ohio Memory

Everything at Ohio Memory is digital and keyword searchable thanks to Optical Character Recognition (OCR). However, they do sometimes connect back to other catalog records.

Search Tip: Finding Images at Ohio Memory
When you use the search box on the home page you will be searching both the text and the metadata provided by the contributor. If you want to search just visual items (photos, images, etc.) select “exclude full text sources.”

It’s important to use keywords relevant to the time period that you are searching. Restrict your format to what you want right from the homepage.

Historical Newspapers at Ohio Memory

The newspaper collection of Ohio Memory does not overlap with the Library of Congress’ Chronicling America collection, but they are all part of the same story and collection. They have contributed a large amount of newspapers to Chronicling America over the years. At last count there are a million pages between the two collections.

Ohio Memory focuses on titles and time periods different from the content on Chronicling America. At Ohio Memory you’ll find deeper runs of newspapers and more recent newspapers. New newspaper content is being added regularly.

They also have some very early newspapers that are significant to Ohio history such as the Ohio State Journal which was the paper of record for Ohio during the 19th century. The Ohio State Journal collection covers 1830-1875 an important time period in Ohio’s growth and the Civil War.

The Lebanon Western Star newspaper from southwest Ohio near Cincinnati and Kings Island is another important newspaper. It covers Ohio history from a more rural area.

Old Yearbooks at Ohio Memory

A lot of Ohio Memory’s public library partners have access to yearbook collections through their partnerships with local schools. Many have worked to digitize their materials and put them on Ohio Memory. Some are quite early, some more recent although not very recent due to privacy concerns.

Many of the yearbooks at Ohio Memory come from northwest and northeast Ohio. You’ll also find student histories from southwest Ohio from a couple of universities, as well as other related materials such as student photos.

Is Ohio Memory Free?

Yes! They used to have one collection that was behind a pay wall. That was the Underground Railroad Wilbur H Siebert collection which features information about underground railroad activities in Ohio and beyond. It’s a strong resource for looking at research methods of the era, and the stories of how the underground railroad operated. That collection was opened up a couple of years ago and has remained free.

The Future of Ohio Memory

They continue to digitize and add new materials based on their strategic goals. Recently they focused on President Warren G. Harding since it is the 100th anniversary of his election. They are continuing to add more content to that collection.

Ohio Memory has about 40 active partners around the state that are choosing items from their own collections for inclusion. Examples include Wood County in northwest Ohio, Mount Saint Joseph University and the Sister of Charity in the Cincinnati area. They welcome new partners every year.

While you may or may not find things specifically about your ancestors, Ohio Memory offers a wonderful opportunity to find things that help fill in their story and their community.

You are free to use items for educational and personal use without needing extra permission. If you’re a family historian and you are wanting to put a picture in a presentation for your family or you just want to keep it with your own research records, you are welcome to do so.

Freedmen’s Bureau Records

FamilySearch is always busy bringing new, exciting and unique record collections to genealogists, and the Freedmen’s Bureau records certainly fall into that category. FamilySearch Deputy Chief Genealogical Officer at FamilySearch, Thom Reed spearheaded the project.

What was the Freedman’s Bureau?

The Freedmen’s Bureau (known as The Bureau of Refugees Freedmen and Abandoned Lands) was established shortly after the Civil War to help newly freed individuals and poor Southerners get back on their feet and start anew.

The Department of the Army established the Freedmen Bureau field offices and local offices in 15 states and the District of Columbia where people could seek assistance. Many African Americans who had been enslaved were on their own and they needed, work, food and housing. In the course of administering that help the government kept great records. These records were sometimes the first records of African Americans in this country. Many had not been documented before, or perhaps were only listed by first name. These records form a sort of bridge between the “1870 brick wall” often found in African American research and earlier records.

Freedmen’s Bureau Years of Operation

The Freedmen’s Bureau operated between 1865-1872. It was difficult to maintain. After it closed, other programs surfaced. In some cases, states took over the programs.

What types of records can be found in Freedmen’s Bureau Records?

While not all the records created by the Freedmen’s Bureau are genealogically relevant, many are.

Freedmen’s Bureau Records Include:

  • Labor contracts
  • Apprenticeship records
  • Solemnized marriages
  • Education records
  • Hospital records
  • Court documents and complaints
  • Food Ration records
  • Correspondence (this is the majority of the records and may name people)
  • Banking records

The Freedmen’s Bureau Project

The Freedmen’s Bureau Project extracted the genealogically relevant information so that volunteers could index it and make it searchable. This effort resulted in 1, 783,463 names being made searchable.

There’s also pages and pages of documentation that are not yet indexed. They didn’t index a lot of the correspondence. You will need to use the finding aids, descriptive guides and pamphlets and go through and look at the images. All of the images are available online to view.

The Freedmen’s Bureau Project was completed in 2016, just 366 days since it began.

FamilySearch partnered with many organizations and 25,550 volunteers to complete the project including:

  • The National Archives and Records Administration
  • National Museum of African American History and Culture
  • They opened in 2016, and as a gift FamilySearch gave them the database.
  • Societies include the Afro American Historical and Genealogical Society – several of their 35 chapter across the United States assisted with the indexing.

How to Access the Freedmen’s Bureau Records

You can access the Freedmen’s Bureau records though FamilySearch or the Discover Freedmen website.

Where you start depends on what you want to do and what you know. For many people, Discover Freedmen is a good place to start. You can simply enter your ancestor’s first and last name and it will search all of the indexed collections that they have available at FamilySearch including the Freemen Bank records which was a separate entity from the Freedmen’s Bureau. It will allow you to search all of those record collections together and show you where that name appears.

If you know the location or the specific type of record you are interested in, you may want to go directly to FamilySearch and start searching.

The Freedmen’s Savings and Trust Bank

The Freedmen’s Bank was a separate entity from the Freedmen’s Bureau. It was based in Washington D.C. After the war it allowed newly freed individuals to deposit their funds in a bank account and start to establish some kind of wealth.

The Freedmen’s Savings and Trust Bank operated from 1865 to 1874, just a little bit longer than the Freedmen’s Bureau.

The interesting thing about their deposit records is that to be a depositor you had to include information about your family and where you lived. This means that in these records you may find entire family groups listed in a depositor’s application. You could find a husband and wife, all their children, where they lived, and in some instances who they were formerly enslaved by.

Unfortunately, due to mismanagement and other financial issues, they closed. However, the  records remain. The National Archives and Records Administration held those records for years, and FamilySearch indexed them back in 2001. Over 469,000 names and the associated digitized images can be found in the collection database at Familysearch.

Part 3: Photo Restoration and Animation Video

In celebration of St. Patrick’s Day I did some restoration work on an old photograph of my great, great, grandmother that was taken in the 1920s. She came to American from Limerick Ireland in the 1850s. Here’s the process I followed to create it:

  1. Digitize the image at the highest resolution possible.
  2. Restore the photo first – I use the free Adobe Photoshop Fix app on my phone.
  3. Head to MyHeritage and use the Enhancer tool to further improve the image.
  4. Then use MyHeritage’s Colorization tool if desired.
  5. Apply MyHeritage’s Deep Nostalgia tool to animate the face.
  6. I compiled the images and rendered the final video using Camtasia. This video software program made it possible to transition from photo to animation and back again.

Recently Donna watched one of my Evernote for genealogy webinars. She wrote in afterward to give the webinar a thumbs-up and ask this question about how to organize notes in Evernote notebooks:

“I…have been happily using Evernote for a while now so I already have lots of notes, notebooks and stacks. Got web clipper, made my Genealogy and Personal notebooks, added tags you suggested, and discovered Evernote Clearly is no longer available. But you’re right, I’ve lost some of the notes in the myriad. What is the best way to begin putting notes into the new Genealogy & Personal notebooks?  Is there another video on that? Thanks for being there for us, Lisa, All our stuff can become overwhelming if it can’t be organized.”

I’m so glad that Donna found the video helpful!

The thing about getting organized is that sometimes it can gobble up all your research time. So one approach I often recommend is just to move Evernote notes as you use them. That way you can keep researching, while getting more organized each day. As you create new notes you’ll be putting them directly where they belong, and as you use existing notes, you can tidy them up as you go.

If you feel more comfortable getting everything moved in one fell swoop, that’s good too. One way to save time is with a simple trick: decide what you have more of (Genealogy or Personal) and then move ALL your notes into that notebook. So if you have more Genealogy notes, all your notes will be in that notebook. Now you only have less than 1/2 of your notes that need to be moved to Personal.

You can move the rest to the other notebook by selecting multiple notes at once. Here’s a step-by-step breakdown:

1. Click the Genealogy notebook in the left column.
2. In the center column are all of your notes. Click the first note in your list to be moved.
3. Hold down the Control key on your keyboard.
4. Now click to select each additional note you want to move to the Personal notebook. (Use the wheel on your mouse to scroll down as you need to.) Your notes will be collecting in the right-hand window pane, and a dialog box will appear.
5. In that dialog box, click the Move to Notebook button and click to select the desired notebook from your list (ex. Personal).
6. For good measure, click the Sync button to manually synchronize all of your notes.

I heard back from Donna with this comment:

“Thank you Lisa! Within a matter of minutes I was able to move my notes and notebooks into the two stacks.  Now that Personal and Genealogy are separated, I’ll follow your suggestion to tidy up the notes as I go and add all my tags (which I hadn’t realized the importance of before the video). Ahhhh!  It feels so good to have it clearly organized! You rock, Lisa!”

A: Death records, marriage records, church records (keep an eye on extended family), passenger lists, naturalization papers. Keep an eye out for extended family members who may have come from the same place. Be aware of traditional Irish naming conventions and patterns.

I can tell whose turn it is to unload the dishwasher by the state of the silverware drawer. If either of the boys have done it (ages 13 and 11), the forks are haphazardly in a jumble and the spoon stack has overflowed into the knife section, and the measuring spoons are nowhere to be found. If, on the other hand, it was my daughter (age 8), everything is perfectly in order. Not only are all the forks where they belong, but the small forks and the large forks have been separated into their own piles and the measuring spoons are nestled neatly in size order.

Regardless of the state of your own silverware drawer, it is clear that most of us need some sort of direction when it comes to organizing our DNA test results. Organizing your matches entails more than just lining them up into nice categories like Mom’s side vs. Dad’s side, or known connections vs. unknown connections. Organizing your results involves making a plan for their use. Good organization for your test results can help you reveal or refine your genealogical goals, and help determine your next steps.

The very first step is to download your raw data from your testing company and store it somewhere on your own computer. I have instructions on my website if you need help.

Once that is complete, we can get to the match list. One common situation for those of you who have several generations of ancestors in the United States, you may have some ancestors that seem to have produced a lot of descendants who have caught the DNA testing vision. This can be like your overflowing spoon stack, and it may be obscuring some valuable matches. But identifying and putting all of those known matches in their proper context can help you realize these abundant matches may lead to clues about the descendant lines of your known ancestral couple that you were not aware of. In my Organizing Your DNA Matches quick sheet I outline a process for drawing out the genetic and genealogical relationships of these known connections to better understand their relationship to each other and to you. It is then easier to verify that your genetic connection is aligned with your known genealogical paper trail and spot areas that might need more research.

This same idea of plotting the relationships of your matches to each other can also be employed as you are looking to break down a brick wall in your family tree, or even in cases of adoption. The key to identifying unknowns is determining the relationships of your matches to each other, so you can better see where you might fit in.

Another helpful tool is a trick I learned from our very own Lisa Louise Cooke, and that is Google Earth. Have you ever tried to use Google Earth to help you in your genetic genealogy? Remember that the common ancestor between you and your match has three things that connect you to them: their genetics, surnames, and locations. We know the genetics is working because they are showing up on your match list. But often times you cannot see a shared surname among your matches. However, by plotting their locations in the free Google Earth, kind of like separating the big forks from the little forks, you might be able to recognize a shared location that would identify which line you should investigate for a shared connection.

So, what are you waiting for? Line up those spoons and separate the big forks from the little forks, your organizing efforts may just reveal a family of measuring Spoons, all lined up and waiting to be added to your family history.
